I would advise you to look at RFE very carefully, Sometimes they issue RFE that may read to include more than one kind of proof so you may be able to submit alternative proofs such as affidavits, wedding pictures, wedding invitaion etc. I am just throwing an idea here.
I got a chance to take a look at 140 RFE that was issued recently. The language used was pretty broad for certain kind of proof they were requesting. You may have a chance to submit alternatives.

It's not the "IMHO" or anything... we certainly all are entitled to opinions - "Canon is better than Nikon" "Nikon is better than Canon" "Contax/Carl Zeiss is better than either" "What are you thinking, Minolta has fine glass too" etc. But it is just the "far superior" thing that got me going, because it simply isn't true, while the other statements certainly do have parts of truth to them. I guess some people do treat camera manufactureres with the same kind of "fanboy-ishness" that geeks do to Intel or AMD. ;)

Dear Friends,
I have an approved I-140 with PD of Mar 06, but i left this company to join a new company. I have tried many times to file PERM through this new company but still unsuccessful. I am waiting to withdraw my PERM appeal to file a new PERM since January 09 (so folks don't ask me to update my profile because i am yet to file PERM, I have updated my profile three times since 2006 and also cleared it).
Question: When i spoke to my company's lawyer regarding my earlier I-140 they say that first i need to get my PERM approval (I agree) and than i need to get my I-140 approval (Which i am not sure) inorder to port priority date, is it true? Can't we port Priority date along with I-140 application itself?

We are talking two different things here. You are saying about AC-21. The OP is asking about retaining PD. The way you can retain your PD after I-140 approval is :-
You file a new labor with the new employer - once it is approved - you need to file a new I-140 application and attach the old approved application with it - this would ensure that your PD will become the PD from the old case.
Difference with AC21 is - in the case of AC21, you just switch jobs and your current GC process continues - you do not have to file a new labor,140 etc.

OK, for those who thought my name suggestion was serious , well I was just kidding, cuz this topic itself was a joke so I just played along with it,
I am not really effected by GC delay, cuz I was able to file I-485 in 2004 and I changed my job twice using AC-21 (refer to AC-21 thread I explained my situation), Also my wife is working with EAD, so I have no reason to go insane, but remember I still contribute to IV and itz cause, while I know many guys stuck in labor for last 5-6 years are still skepctical about IV.
Now back to H1B subject, I am glad IV is not promoting H1B increase, just because I came in H1B it does not mean H1B any better,
Why do I care about H1B.
Because I have been here for almost 10 years and I have seen how this program is abused, c'mon gusy we are educated and qualifed and we should not be so desparate to come to US by any means, when I say abolish H1B it does not mean I am against immigration, I just want reform the system where people have more option when they came here, How many of you guys are still hanging onto same company with same salary, think rationally and think beyound GC

1) First one should change the employer with new job.
2) Apply for new Labor (with EB2 requirements) -- PERM 3 months.

I also did switch job back in July 08. Immediately after the switch the new company had sent all documents necessary for AC21 with the help of their lawyer. USCIS have reviewed my application in October and in February for pre-adjudication. How I am sure about that is because in Feb my wife got an RFE for Medical and mine was fine. Unless the primary is fine they will not touch dependent.
So here is what you should do.
1. Contact your current company lawyers.
2. Educate them what AC21 is, I guess there was an updated AC21 Memo in May 08. My lawyer included the whole memo highlighting the clause under which I am eligible to switch job (Same or similar , I was a Senior Software Engineer, now I am Software Engineer IV, each company has its own classification).
3. Submit EVL (Employment Verification Letter) from your current employer.
4. Submit a letter explaining your eligibility for AC21.

5. Submit a G28 (Change of representation) for you and all your dependents. Along with that submit the AC21 documents only then the AC21 documents will reach your file. The same is recommended by attorney Murthy.

Absolutely. Assuming your I-140 is approved/approvable and will not be withdrawn, you will be able to AC21 to your new position after 180 days of I-485 pending. And the best thing, it will only depend on similarity of the job, and no ability to pay questions. Good luck!

It is FBI that is responsible for namecheck ... not sure USCIS has any control over them. My understanding is I-485 premium processing would apply only to USCIS processing of the paperwork.
Then, of course, it won't help much because for most people name check is taking 2 years, and 485 processing via the regular route takes less time than that.

There would be many of us who would be able to relate to this article . I don't feel it is totally false, I guess this is the author's Memoir (partly true & partly made up ) & not his autobiography.
(made up part is what the author foresees in the future - reason given below )
- If not parents then it might be grandparents who kept waiting/hoping to see their grandson/granddaughter's children but passed away without seeing them.
- Latter part (what sounds like made up part ) is what the author saw in working/service class families in the US who came here 20 - 30 years ago (i hv myself come across such families) & believes his future would be the same - who knows it can be true for anyone ???
During youth a guy is busy in his job, is able to pay all his bills as well as save some money for vacation, which happens during long weekends or once a year , life goes by like this but when he grows older/retires & wishes to go back & settle down he finds things are not what he wants or wanted - children dislike staying/going to india , they study in a college in a different city , visit them once in a while , he & his wife r left alone & find it very lonely here. He knows he has not become a multi-millionaire & looks back & realizes he has always lived a hand-to-mouth life - BUT Is this what he wanted ? was all this worth it ?
He could never reach a conclusion & one day he passes away. Now his wife is left alone even lonelier & she has the same questions.
She visits india every year for 1 or 2 months - she likes it there. But
She cannot settle there - it will make her far from her children , She cannot settle here - because her roots are there.

guys,
you need to understand why we were in DC. you also need to think about what message we were sending. each person's philosophy about national anthems is not at issue here. this is a pointless discussion. frankly i am tired of people (i am one) that do not live in their countries but lose no opportunity to retreat in jingoistic nationalism. want want want...but no give?
if no one has serious objection, i will close this thread shortly. the above comments are not for any specific person/poster. just a general view.
